By downloading or using Alowa, you agree to these terms. Please read them carefully.

The App

Alowa is a personal mood tracking and journaling application with AI-powered features. The app is provided by:

License

Alowa grants you a personal, non-exclusive, non-transferable license to use the app for your personal journaling purposes. You may not:

• Copy, modify, or reverse engineer the app

• Sell, rent, lease, or sublicense the app

• Use the app for any illegal or unauthorized purpose

• Attempt to extract the source code or circumvent any security measures

Your Responsibilities

Data Backup

All your journal entries are stored locally on your device. You are solely responsible for backing up your data. We recommend:

• Enabling iCloud Backup on your iPhone (which will include Alowa's data)

• Regularly backing up your device to your computer

We are not responsible for any data loss that may occur.

AI-Generated Content

Alowa uses artificial intelligence to analyze and respond to your journal entries. You acknowledge that:

• AI-generated insights and responses are not professional advice (medical, psychological, legal, financial or otherwise)

• AI can make mistakes or provide inaccurate information

• You should not rely solely on AI-generated content for important decisions

• If you're experiencing mental health issues, please consult a qualified professional

Disclaimer of Warranties

Alowa is provided "as is" and "as available" without any warranties of any kind, either express or implied, including but not limited to:

• Warranties of merchantability or fitness for a particular purpose

• Warranties that the app will be uninterrupted, error-free, or secure

• Warranties regarding the accuracy or reliability of AI-generated content

Limitation of Liability

To the maximum extent permitted by Swiss law, specifically the Swiss Code of Obligations (CO), [Your Name/Company Name] shall not be liable for:

• Any indirect, incidental, or consequential damages, including but not limited to loss of profits, loss of data, or business interruption

• Damages resulting from technical faults, transmission errors, or network overloads.

• Actions or omissions of auxiliary persons (Art. 101 CO) and third-party service providers.

Liability for damages caused by unlawful intent (Vorsatz) or gross negligence (grobe Fahrlässigkeit) remains unaffected pursuant to Art. 100 para. 1 CO. Liability for personal injury (damages to life, body, or health) and claims under the Swiss Product Liability Act (PrHG) also remain unaffected. Liability for slight negligence (leichte Fahrlässigkeit) is hereby excluded to the extent permitted by law.

App Availability

We strive to keep Alowa available and functional, but we do not guarantee:

• That the app will always be available or work without interruption

• That the app will be compatible with all devices or future iOS versions

• That cloud AI services will always be accessible

Changes to the App and Terms

We may:

• Update the app with new features, improvements, or bug fixes

• Modify or discontinue features

• Update these Terms of Use

Significant changes to these terms will be communicated through the app or by updating the "Last updated" date. Continued use of the app after changes constitutes acceptance of the new terms.

Termination

You may stop using Alowa at any time by deleting the app from your device. We may terminate or suspend your access to the app if you violate these terms.

Governing Law

These terms are governed by the Swiss laws.

If you are a consumer residing in the European Union, you also benefit from any mandatory provisions of the law of the country in which you reside.

Severability

If any provision of these terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

Entire Agreement

These Terms of Use, together with our Privacy Policy, constitute the entire agreement between you and Etienne Baume regarding Alowa.
